　　律師稱，從前有的案子可以上訴，但今年被拒絕的案子幾乎都毫無理由，退回的案子許多是移民局認為“所申請的職位不是公司必要的”，這讓案子很難上訴，無法去反駁移民局。按照聯邦法律，移民官有自主裁決權，許多案子上訴也沒有好理由。這兩年H-1B補件比例比較高，尤其是學商和學文的。
　　華通夏令營老師指出，移民官要從幾個方面審核申請，其中一個就是要問這個公司需不需要你的專長。最近幾年商科畢業(yè)生比較多，這種商科專業(yè)可以在很多地方工作，他們可以在各種行業(yè)工作，有點像“萬金油”，所以移民局會有疑問，這樣審批難度就會加大。
　　律師還舉例說，從前有很多申請市場調查的案子都被通過了，但是現在這種案子特別容易被要求補件，如移民官會問申請人的公司有做了哪些市場調查服務，并要公司出示市場調查成員的具體分工細節(jié)。
